These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and MailBridge Pro LLC ("MailBridge Pro," "we," "us," or "our"), a Delaware limited liability company operating at 1201 Wilson Blvd, Arlington, VA 22209. By registering for or using the MailBridge Pro platform, you agree to be bound by these Terms.
MailBridge Pro provides transactional email infrastructure services including SMTP relay, REST API access, delivery analytics, and compliance tooling for system-generated, opt-in transactional emails. The platform is expressly not designed or licensed for bulk marketing email, unsolicited commercial email, cold outreach, or any use prohibited under our Acceptable Use Policy.
You must be at least 18 years of age and legally authorized to enter binding contracts on behalf of yourself or the business entity you represent. By creating an account, you represent and warrant that you meet these requirements and that all information provided during registration is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@mailbridgepro.us of any unauthorized access to your account. MailBridge Pro is not liable for losses arising from unauthorized use of your account credentials. We reserve the right to require additional verification of your identity or business at any time.
Your use of the MailBridge Pro platform is governed by our Acceptable Use Policy, which is incorporated by reference into these Terms. You agree not to: (a) send unsolicited emails to recipients who have not explicitly opted in; (b) use purchased, rented, or scraped email lists; (c) engage in phishing, spoofing, or email fraud; (d) violate the CAN-SPAM Act, GDPR, or other applicable laws; (e) send content that is illegal, harmful, or violates third-party rights; or (f) interfere with the integrity or security of the platform.
Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as expressly stated herein or required by law. We reserve the right to modify pricing upon 30 days' written notice to registered customers. Failure to pay fees may result in suspension or termination of your account. You are responsible for all applicable taxes.
MailBridge Pro may suspend or terminate your account immediately and without notice if: (a) you violate the Acceptable Use Policy; (b) your sending practices generate complaint rates above acceptable thresholds; (c) we receive credible abuse reports implicating your account; or (d) continued operation presents legal, reputational, or technical risk to MailBridge Pro or its other customers. You may terminate your account at any time by notifying us in writing.
MailBridge Pro commits to 99.9% platform uptime, excluding scheduled maintenance windows, force majeure events, and circumstances beyond our reasonable control. Enterprise customers receive enhanced SLA terms as specified in their service agreements. Uptime credits are available as described in our SLA documentation.
MailBridge Pro retains all intellectual property rights in the platform, software, documentation, and proprietary systems. You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your own business purposes. You retain ownership of content you generate and transmit through the platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAILBRIDGE PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MAILBRIDGE PRO DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT EMAILS WILL BE DELIVERED TO ANY PARTICULAR INBOX OR AT ANY PARTICULAR TIME.
These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration in Arlington, Virginia, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may modify these Terms at any time. Material changes will be communicated to registered customers by email at least 14 days before taking effect. Continued use of the platform constitutes acceptance of the modified Terms.

This Acceptable Use Policy ("AUP") governs the use of the MailBridge Pro transactional email infrastructure platform. All customers must read, understand, and agree to this AUP before accessing live sending capabilities. Violation of this AUP may result in immediate account suspension, permanent termination, and referral to law enforcement.
Zero Tolerance Policy: MailBridge Pro operates a zero-tolerance policy for spam, unsolicited bulk email, and use of purchased or scraped email lists. These violations result in immediate, permanent suspension with no appeal period.
MailBridge Pro may only be used to send transactional and system-generated emails to recipients who have explicitly opted in to receive such communications from your platform. Permitted email categories include:

We strongly recommend β and for some use cases require β the use of double opt-in verification to confirm recipient consent. Pre-checked consent boxes, implied consent, and consent buried in terms and conditions do not meet our requirements.
Customers must maintain the following sending quality standards at all times:
All commercial emails sent through MailBridge Pro must comply with the CAN-SPAM Act of 2003, including: a valid physical postal address in every email; honest and non-deceptive subject lines; clear identification as an advertisement where applicable; a functional opt-out mechanism honored within 10 business days; and accurate From, To, and Reply-To header information.
Customers sending emails to recipients in the European Economic Area must comply with GDPR, including maintaining records of consent, honoring data subject access and deletion requests within required timeframes, and ensuring all personal data processed through the platform is covered under a valid legal basis.
MailBridge Pro continuously monitors all sending activity for indicators of abuse including abnormal bounce rates, complaint spikes, sending pattern anomalies, and IP reputation signals. When violations are detected:
If you have received an unsolicited email that appears to have been sent through MailBridge Pro infrastructure, or if you are aware of a customer violating this AUP, please contact our Trust & Safety team immediately at abuse@mailbridgepro.us. Include full email headers and all relevant details. All reports are reviewed within 4 business hours.
Customers are solely responsible for ensuring that their use of MailBridge Pro complies with this AUP, all applicable laws, and any regulations specific to their industry. MailBridge Pro is not responsible for the content of emails sent by customers. Customers indemnify and hold harmless MailBridge Pro from any claims arising from their violation of this AUP.
